Terms of Membership and Lab Use
KN Creative Academy and Drawing Labs

The Services are operated by KN Creative, trading as KN Creative Academy (“KN Creative Academy”, “we”, “us” or “our”).

These Terms apply to kncreativeacademy.com, Academy memberships, community areas, free Lab previews, individual Drawing Labs, All Labs access, downloads and related online services (together, the “Services”).
The product page and checkout form part of the contract. If product-specific information conflicts with these Terms, the product-specific information takes priority for that purchase.
The Academy provides the lessons, resources, community features and feedback described on the Academy product page. Active Academy membership also includes access to the current Drawing Labs while that membership remains active.
The Drawing Labs are browser-based practice tools for skills such as value, measurement, light and form, lens effects, perspective and colour.
Content and features may develop over time. We may correct errors, improve interfaces, replace outdated material and make reasonable changes for security, legal, educational or technical reasons. We will not materially reduce a paid service without a valid reason and an appropriate remedy where required.
Purchases and community participation are intended for people aged 18 or over unless we have agreed a separate arrangement in writing.
The product description, total price, billing interval, minimum commitment and renewal terms are shown before you order. Check them carefully before completing checkout.
Your order is accepted when we send confirmation or activate access, whichever happens first. We may reject an order for a legitimate reason such as an obvious pricing error, suspected fraud or inability to supply the product. Any payment taken for a rejected order will be returned.
Payments are processed by the provider shown at checkout. We do not normally receive or store your full card number.
A subscription renews automatically at the interval shown at checkout until cancelled. You authorise the initial and renewal payments described at checkout.
If a renewal payment fails, we may retry it, ask you to update your payment method or suspend paid access while the payment remains outstanding.
We may change a future renewal price for a genuine commercial reason. We will give reasonable advance notice. The new price will not apply retrospectively, and you may cancel before it takes effect.
You can cancel a recurring subscription through My Account where that facility is available, or by emailing kevin@kncreativeacademy.com. Cancellation stops future renewals. Unless a refund or statutory remedy applies, access continues until the end of the period already paid for.
Your statutory cancellation rights, immediate-access consent, refunds and the model cancellation form are explained in the Cancellation and Refund Policy.
When an Academy subscription ends, Academy-only lessons, community areas and included Lab access end at the end of the paid period. Separately purchased active Lab access is not removed merely because Academy membership ends.
We aim to keep the Services available but do not promise uninterrupted or error-free access. Maintenance, hosting incidents, browser changes, cyber incidents and events outside our reasonable control can cause interruption.
You need a compatible device, current browser and stable internet connection. Some Labs also need WebGL or similar graphics support. Product pages or Lab notices may state additional requirements.
If a paid service is unavailable for an unreasonable period, contact us. We may restore or repeat the service, extend access, provide a price reduction or refund where fair and legally required.
The Academy and Labs are educational aids. Artistic progress depends on practice, experience, time, materials, health, equipment and individual judgement. We do not promise a particular result, qualification, income or professional outcome.
Do not use Lab output where professional certification, medical accuracy, engineering, construction, surveying, safety-critical measurement or legally reliable colour matching is required.
Feedback is educational opinion. You remain responsible for deciding how to apply it to your own work.
Academy text, videos, demonstrations, images, diagrams, downloads, software, interfaces, datasets, 3D assets, code and branding are protected by intellectual-property law.
We give you a personal, non-exclusive, non-transferable licence to use the material for your own learning during the applicable access period. You may print supplied worksheets and create your own notes and artwork.
Without written permission, you must not share lessons or downloads, distribute source images or models, record substantial parts of the Services, extract protected data or code, remove rights notices, provide account access to another person, or use our material to create a competing course, reference library or software product.
You may display and sell your own original artwork made through your learning, provided you do not distribute our underlying teaching material or infringe rights in a third-party reference.
You keep ownership of artwork, comments, photographs and other material you upload (“User Content”).
You give us a limited, non-exclusive permission to host, store, back up, reproduce and display User Content only as needed to operate, secure and moderate the Services and show it to the audience you selected.
We will not use identifiable User Content in public advertising, testimonials or social media without separate permission, unless you have already made the content public and the use is otherwise lawful.
You confirm that you own the User Content or have permission to upload it. Community participation is also governed by the Community Guidelines.
We may take proportionate action where reasonably necessary because of serious or repeated breach, non-payment, account sharing, harassment, unlawful activity, fraud, security risk or attempts to bypass access controls.
Except where urgent action is needed, we will normally provide a warning and a reasonable opportunity to correct the issue. Action may include removing content, restricting a feature, temporary suspension or ending access.
If we permanently discontinue a paid service for reasons not caused by you, we will provide a fair remedy for the unused paid period. Ending access because of serious breach does not remove any statutory right that cannot lawfully be excluded.
We will provide services with reasonable care and skill. Digital content must meet the standards required by consumer law. If paid content is faulty, misdescribed or unavailable for an unreasonable period, contact us so that we can investigate and provide the appropriate remedy
If you are a consumer, we are responsible for losses that are a foreseeable result of our breach or failure to use reasonable care and skill. We are not responsible for losses that were not foreseeable when the contract was made.
The Services are supplied for personal learning. We are not responsible for business losses arising from business use that was not agreed with us.
Send complaints to kevin@noonan.me.uk with your account email, order number and a clear description of the issue. We aim to acknowledge ordinary customer complaints within five working days and provide a substantive response within 14 days, although complex matters may take longer.
Data-protection complaints are handled under the process described in the Privacy and Cookie Notice.
We may update these Terms to reflect changes in law, security, technology or the Services. Material changes affecting an active paid subscription will be communicated in advance where practical. We will not use an update to remove accrued rights or impose a material disadvantage without a valid reason.
If part of these Terms is unenforceable, the remaining parts continue to apply. A delay in enforcing a right does not waive it. You may not transfer your contract or account without our agreement.
These Terms are governed by the law of England and Wales. Consumers retain mandatory protections and court rights that apply where they live.

We share only what is reasonably necessary with service providers that help run the Services. These may include website hosting and backup providers, WordPress and related platform support, WooCommerce, BuddyBoss, LearnDash, Stripe or another payment provider, email providers such as MailerLite or MailPoet, and Google analytics services where enabled and permitted by your choices.
We may also share information with professional advisers, insurers, accountants, regulators, courts, law-enforcement bodies or a business successor where legally necessary and appropriately protected.
Community content is visible to the audience indicated by the platform settings. Do not post sensitive information that you do not want other members to see.
Some providers may process information outside the United Kingdom. Where this happens, we use a lawful transfer mechanism and appropriate safeguards. Further details are available on request.

Depending on the circumstances, you may have rights to access, correct, delete or restrict your information; object to processing; receive certain information in a portable format; and withdraw consent.
Email kevin@kncreativeacademy.com to exercise a right. We may need to verify your identity. Rights are not absolute and legal exemptions may apply.
You may complain to us if you believe we have used personal information in breach of data-protection law. Send the complaint to kevin@kncreativeacademy.com.
We will acknowledge receipt within 30 days, take appropriate steps to investigate without undue delay, keep you informed where appropriate and tell you the outcome.

Promotional email consent is optional and separate from accepting the Terms. You can unsubscribe using the link in an email or by contacting kevin@kncreativeacademy.com. We may still send non-marketing messages needed for orders, access, security, legal notices or material service changes.
Cookies and browser storage help the website and Labs operate. We use the following categories:
We tell you what storage is used and why. We ask for consent where the law requires it. Optional analytics or marketing technologies should not load until you have made the relevant choice, unless a documented legal exemption applies.
You can accept, reject or change optional choices through your browser of choice. Rejecting optional cookies should not prevent core account, checkout or Lab access.
Lab browser storage may be cleared through your browser, but doing so can reset local settings or progress.
Administrators may access content, including messages, only where reasonably necessary for support, security, moderation, a reported issue or legal compliance. Access should be limited to authorised people.
Forum posts may remain meaningful after an account closes. Where appropriate, we may anonymise a post rather than remove an entire discussion, unless deletion is required by law or the content should be removed for another reason.
Purchases and community areas are intended for adults aged 18 or over unless a separate arrangement has been agreed. Contact kevin@kncreativeacademy.com if you believe a child has provided personal information.
We do not currently make solely automated decisions that produce legal or similarly significant effects. Automated systems may help detect spam, fraud, failed payments or security risks.
We use reasonable technical and organisational measures, including access controls, software updates and backups. No online system can be guaranteed completely secure. Use a unique password and report suspected compromise promptly.
We will update this notice when our processing, providers or legal obligations change. Material changes will be highlighted or communicated where appropriate.
